Welcome to DiamondsByShay.com! This User Agreement (“Agreement”) sets forth the terms and conditions that apply to your use of the DiamondsByShay.com website (“Site”). Shay’s Diamonds & Jewelry is based in Sacramento, California and is a wholly owned subsidiary of its parent California corporation. Shay’s Diamonds, the Site and its parent company are collectively referred to throughout this agreement as “we”, “us” or “our”. Please read this Agreement carefully as it is legally binding between you, and any entity you may represent, and us. We are the operator of the Site. Our contact info is:

Before using our Site in any manner, including but not limited to: browsing on our Site; purchasing an item on our Site; registering on our Site; communicating on our Site and/or subscribing to our ‘Special Hot List’ newsletter (“newsletter”), you must first read, understand and accept all the terms and conditions of this Agreement, which includes the text of this document, our Privacy Policy, our ‘guarantee’ policy and any other statements, documents and/or links to information on our Site pertaining to our guidelines, policies and requirements. You may use the Site and/or purchase items from us only if you accept this Agreement in its entirety, without modification. Your use of our Site in any manner and/or your purchase of our product(s) constitutes the fact that you have read, understood and accept this agreement in it’s entirety along with all supporting statements, documents, pages and links.

We reserve the right to change, alter or modify this Agreement at any time and for any reason that we deem necessary or appropriate. Any changes made will take effect immediately upon the revision date being posted, unless we state otherwise. Your continued use of this Site following any revision we post will constitute your acceptance of the changes we have made.
When we change this Agreement, we will note the “Revision Date” above. When changes are made, we will attempt to notify by e-mail all the users of this Site who have registered on our Site and provided us their e-mail address. We will also post a notice on this Site’s homepage for a period of 14 days indicating that a revision has been made to this Agreement. In any case, we encourage you to review this Agreement from time to time to see if it has been revised.

This Agreement controls to whatever extent it may conflict with our Privacy Policy, our ‘guarantee’ information and any other statements, documents, policies, pages and/or links structured internally within our Site or issued through some other means (retail material, printed matter or otherwise) by Shay’s Diamonds with the understanding that all other provisions in the various documents and policies that are not in conflict shall remain intact and enforceable.

This Agreement applies to our Site only, not to other websites that you may reference or link to from our Site or through other means. Those other websites may have different user agreements and are not controlled by us.

1. Available Service Area:

The Site is currently offered for use within the United States of America, Canada and selected international countries.

2. Residency and Minimum Age Requirements:

All users of the Site must be a minimum of 18 years of age or older and legally recognized as a mentally competent adult in the country or province they reside in. We assume no liability or responsibility for anyone who uses our Site that would be considered unauthorized as per the requirements stated herein. Parents or legal guardians of such individuals assume full liability and responsibility of the actions of those individuals on our Site.

4. Overview of Our Site:

Our Site provides a platform for viewers and registered users to browse and/or buy diamond rings, jewelry and other items we have listed for sale or display on our Site. Purchases on a local level can be made in person while orders worldwide can also be placed with us via phone, email, fax and/or through the ecommerce engine that may be provided on our Site in which the item will be shipped to the customer. All prices, fees and values presented on our Site are quoted in U.S. dollars unless specifically stated otherwise.

Each item we offer is brand new unless specifically stated otherwise. If an item we offer is not new, but has been cleaned, polished and refurbished by us, we will usually use (but not be limited to) the term “Like New” to describe the item. If an item we offer is not new and has not been cleaned, polished and refurbished, then we will usually use (but not be limited to) the term “Estate Item”. We reserve the right to change our descriptive terms and/or titles at any time and for any reason at our complete determination and discretion.

Each piece of jewelry or item we offer may be listed and offered at a price we select. We typically reference that our items are sold at “wholesale” prices, however, we may also use various other terms and/or titles to describe the price we offer such as (but not limited to): “Shay’s Price”; “Wholesale Price”; “Discount Price” ”; “Special Price”; “Discount Price” and others.

From time to time, we may also put our items on sale or on clearance in which we may use the following terms (but not limited to): “Sale Price”; “Clearance Price”; “Closeout Price”; “Liquidation Price”. Buyers on our Site and local purchases made in person may purchase items at the price we list the item at. We reserve the right to change our prices (posted, printed or otherwise) at anytime and/or retract any items we may have listed for sale at any time and for any reason at our complete determination and discretion.

Should a pricing conflict arise for any reason or between our Site prices and other prices we may quote for the same item (such as; by phone; by fax; by email; in person; on public online listing services; or printed, posted or displayed in any manner) we reserve the right to select, change and/or determine the price at our full discretion and/or retract the item for sale.

There is no minimum purchase required so you can buy as few as one item per order. We accept local orders along with orders from anywhere in the USA, Canada and also from selected international locations worldwide.

We allow both consumers and resellers to purchase items from us or on our Site. You do not need to have a store and you do not need a business license or permit to buy from us or on our Site. Everyone that is of competent legal adult age is welcome to buy on our Site.

We also offer custom ring design and jewelry manufacturing to our customers. Additional fees will apply. Custom ring orders are usually manufactured and shipped within 12 business days but can take longer depending upon the complexity of the ring and diamond availability. Please contact us directly if you’re interested in having a custom ring designed.

We offer many various types of diamonds including certified and uncertified. Many of the rings we offer will come with either a “Certificate of Authenticity” or an “Appraisal Certificate”. Any ring we offer that does not come with a certificate can be graded, certified or appraised at your request for a nominal fee. For the benefit and comfort of our customers, our policy at Shay’s Diamonds is to never perform and produce our own grading documents and certificates on the rings we sell as we feel it would be a conflict of interest. We always use a reputable and independent third-party grading company to perform the certifications on our rings.

If you are not a local customer and your ring needs to be shipped, rings that are in stock usually ship within 3 business days. Custom orders, non-stock items and specialty requests may take up to 12 business days or more before shipment. We will keep you notified via email as to the progress of your order and shipment.

All our jewelry will come with a free elegant gift box with your order unless stated otherwise on the specific item’s description.

If you are not a local customer and your order needs to be shipped, we will ship your ring by either FedEx® 2-day or USPS Priority Mail®. We will determine at our discretion which delivery service we will utilize based upon your location and the price of the ring or jewelry item you purchased. We reserve the right to change shipping methods and/or carriers at our discretion. We will not be responsible for shipping and any other costs you may incur to return an item to us. Customers whose orders are shipped to locations outside the US will be responsible for any custom fees; taxes; duty charges; storage; and/or any other fees that may be applied to the item / shipment. Once we ship an item and it has been confirmed by the carrier that the package has been delivered, we will not be responsible for any item and/or package that is either lost, stolen, damaged or misappropriated. All items we ship are insured with the carrier against shipment theft while in transit and/or damage occurring during transit.

We also offer a guarantee on all the items we sell unless specifically stated otherwise on the item’s description page (please see our ‘guarantee’ information in section 28 of this Agreement). Items returned for store credit as per the terms outlined in our guarantee will be credited for the purchase price of the item less any shipping & handling fees we incurred and/or any other fees we may incur to retrieve the item. If a certificate was included with the item and the item is returned without the certificate (or the certificate is damaged), a $125 fee will be deducted from the store credit. If the original gift box is not provided or if it is returned in damaged condition at the time the item is returned, a $10 fee will be deducted from the store credit.

Shay’s Diamonds offers you a guarantee & return policy on all our beautiful diamond jewelry (please review section 28 of this Agreement below for full details). Returned items that are accepted under the stipulations and conditions of our guarantee policy will be issued store credit - we do not issue refunds of any kind. Items returned for store credit as per the terms outlined in our guarantee will be credited for the purchase price of the item less any shipping & handling fees we incurred and/or any other fees we may incur to retrieve the item. If a certificate was included with the item and the item is returned without the certificate (or the certificate is damaged), a $125 fee will be deducted from the store credit. If the original gift box is not provided (or if the gift box is damaged when the item is returned) a $10 fee will be deducted from the store credit.

5. Revenue Generation:

We primarily generate revenue from the sale of our items on our Site. We may also generate secondary revenue from affiliates, advertisers and third parties who post advertisements, sponsored links and/or banners on our Site and/or on our search results page. They may also pay us to send special offers by e-mail or regular mail to our registered users and/or newsletter subscribers who have agreed to accept such e-mail or mail from us. We are not limited to these revenue generation methods.

6. Our Communications with Users and Members:

As an Internet-based business, we primarily use e-mail to communicate with you regarding your relationship and transactions with us. We also may choose to communicate with you via U.S. Mail, overnight delivery, telephone, text messaging, facsimile transmission, online communication and physical interaction using the contact information that you provide.
With your affirmative consent, we will use your e-mail address(es) to send you messages with the purpose of promoting the use of our Site and/or the purchase of products or services related and/or unrelated to our Site. You may consent to the receipt of such e-mail when you purchase an item from our Site; register on our Site or when you sign up for our newsletter. You may withdraw your consent at anytime by contacting us at ShaysDiamonds@hotmail.com and instructing us to withhold sending you our newsletter and/or promotional emails. Also, each promotional or newsletter e-mail we send you will offer an opt-out option with instructions.

7. Providing Personally Identifiable Information:

When you purchase an item from us locally in person and/or on our Site and/or register on our Site and/or or sign up for our newsletter, you will be providing us with personally identifiable information. You agree that all information you provide to us will be truthful and correct. Please see the Privacy Policy page for a description of our information collection and security practices.

8. Payment Acceptance and Methods:

Local customers in the Sacramento, California area that purchase items in person may make your payment using cash (we may also, at our discretion, accept major credit cards such as Visa; Mastercard; American Express or Discover). Purchases that are not made locally in person must be paid for by either direct deposit into our account or via bank wire. In order to help keep our prices as low as possible, we currently do not accept checks or money orders due to potential fraud issues.

When you place an order with us in person and we choose to accept payment by credit card, you are authorizing us to charge your credit card for the amount of the item you wish to purchase. You will be required to show a valid driver’s license for the state in which it was issued (and/or any other identification credentials we may request or require) and you will be required to sign the credit card receipt as well as our company store receipt. We reserve the right to refuse service to anyone for any reason and we reserve the right to refuse and/or reject an order/purchase and/or payment method at our total discretion - we may modify, change or alter our payment, shipping and return policy at anytime for any reason at our discretion.

9. Registering and Establishing an Account:

You may also have the opportunity to register on our Site and sign in. Registering on our Site allows you to enjoy a much more convenient browsing environment and shopping experience. We do not charge a registration or membership fee. Several accounts can be registered from the same address and/or location provided that each account is created by a separate and different individual.

You will be required to provide personally identifiable information when you register. You will also need to create a User Name and Password. You agree that all information you provide to us when you register and whenever you update your information will be truthful. Please see our Privacy Policy page for a description of our information collection and security practices.

The user name that you select will identify you on our Site. Other users on our Site will not see your identity and/or personal information.

You should take precautions to protect your password and keep it private as this is the key to accessing your account on our Site. When creating your password, you should use a unique combination of numbers and/or letters that are not obvious. Your password should not be the same as your user name.

Beware of scam artists who might masquerade as us in an attempt to get your Personal Information. Should we ever need to validate or obtain Personal Information from you, we will contact you and direct you to provide the requested information through our Site using our correct Site address: (www.DiamondsByShay.com). Even if the request appears to come from us, do not provide any Personal Information except through our correct Site address. Please contact us promptly to report any suspicious communications that you may receive.

The password you create should not be disclosed to anyone. If you choose to share your password with others, they will have full access to your account and your Personal Information. You are responsible for any and all actions taken by anyone who has obtained your user name and password even if those actions were performed by another individual. If you feel your password has been compromised or you are concerned that someone else may have your password, you should change your password immediately by signing in and clicking on your account link. You can then edit your information and change your password. If you ever have any questions or concerns regarding your account or password, please feel free to contact us at anytime.

10. Registration Termination and Unsubscribing to our Newsletter:

If you subscribe to our newsletter, you may unsubscribe at any time by simply contacting us at ShaysDiamonds@hotmail.com. Each newsletter you receive will also have opt-out instructions attached. We reserve the right to cancel, terminate or eliminate our newsletter and/or your subscription to our newsletter at any time and for any reason.

Any account you register on our Site may be terminated and/or suspended by us. We reserve the right to limit, suspend or terminate your account and/or close your account and/or block your ISP address at any time and for any reason we deem necessary or appropriate.

If we have limited, suspended, terminated or cancelled your account, you may not circumvent the action we have taken by re-registering and operating on our Site under other user names and/or other accounts.

11. Purchasing Items And Buying On Our Site:

You may purchase items on our Site or subscribe to our newsletter without the need of registering or signing in. You also have the opportunity to register on our Site and sign in. We do not charge a registration or membership fee. Online orders can be placed by contacting us via phone, email or fax.  We reserve the right to accept or refuse any orders for any reason, whether local transactions on non-local transactions or website orders.

Local customers who purchase items in person can pay for their item using cash or any major credit card. To purchase an item locally, simply give us a call and we’ll make arrangements to show you the items you’re interested in at one of our local showroom locations. Purchases that are not made locally in person must be paid for by either direct deposit into our account or via bank wire. In order to help keep our prices as low as possible, we currently do not accept checks or money orders due to potential fraud issues. If you are not a local customer and wish to place an order with us, please contact us by either phone, fax or email and we will begin processing your order. We accept orders worldwide and can ship our items to anywhere in the USA, Canada or internationally.

All local purchases made in Sacramento or orders shipped to a California address will be charged sales tax. California customers who buy from us with a valid California Resale Permit with the intent to resell our jewelry will not be charged any sales tax. All orders shipped to a location outside of California will not be charged any sales tax.

If your order needs to be shipped, you will be charged an additional shipping & handling fee. The amount of your shipping & handling fee will be based upon your location and the price of your item. We insure every item we ship and we usually ship by Fed Ex 2-day or USPS Priority Mail. Orders shipped to Canada or internationally will also be subject to any custom fees, taxes, duties and/or any other import fees (or other fees) that may be imposed, for which the customer will be responsible for these fees.

Most of our rings are set in 14k gold. If you would like to upgrade the metal to 18k or Platinum, you will need to contact us by phone or email prior to placing your order as additional fees will apply. Likewise, if you’d like to change the center stone on your ring to a different size, shape or quality level, then you will need to contact us first before placing your order.

Receipt and Confirmation: Local customers who purchase their items in person will receive our company receipt and the credit card receipt (if you paid with a credit card). Non local customers will be sent a receipt and confirmation from us for your order via either email and/or regular mail. You will also be sent another notice at the time your item is shipped giving you all the shipment details including a tracking number if available. If there are any delays regarding your item and shipment, we will provide you periodic emails notifying you of the progress.

12. Reselling our Merchandise:

Once you purchase an item from us, it becomes your property and you have the right to do with it as you please, including but not limited to; using the item; selling the item; gifting the item; trading the item; using the item as a prize or premium, etc. When you purchase an item from our Site for your own personal use, you still have the option of attempting to sell it at some point should you decide to do so. You may also purchase items from our Site with the sole intention of reselling the item(s). You do not need to have a store and you do not need a business license or permit to buy from us or on our Site, however, you do need to follow all the necessary legal requirements established by your city, state and/or province to resell merchandise and be in business. We assume no liability if you do not follow the proper procedures in your area to be legally established in conducting business. Once you are properly established, you may sell or market our items through any distribution channels that are permissible by law and that are legally allowed within your country, state and/or local jurisdiction. We take no responsibility and are not liable for any marketing endeavors you may perform with items you purchase from our Site.

Should you attempt to sell or trade an item (or items) that you purchased from us or our Site, we do not imply and we cannot guarantee that you will be successful in selling or trading the item(s) and we do not represent, guarantee or imply that the transaction will be profitable for you should you be able to sell or trade the item(s). Therefore, we will not be liable or responsible for any loss you may sustain from the sale or trade (or attempted sale or trade) of any item(s) you purchase from our Site. We make no claims or warranties (implied or otherwise) regarding the value and/or amount you can sell the item for.

13. “Deal of the Day”, “Special Offers”, “Discounts” and Other Promotions:

We may periodically offer special promotions, giveaways, sales, holiday offers, prizes, discounts and other marketing concepts on our Site. We may also offer a special “Deal of the Day” or “Deal of the Week” or “Deal of the Month” item (or items) which may have a special reduced price and/or be offered for a limited time only. Such items may be limited in quantity and we may have as few as only one item available.

We may also offer discounts for customers who pay for their item using a specific payment method and/or who perform their transaction in a specific manner. We also retain the right to offer discounts to those who serve (or have served) our country in various capacities and/or have been (or are) employed in specific work sectors that we determine at our discretion. We maintain the right to change, alter, modify, retract and/or withdraw any of our promotions, discounts and/or marketing endeavors at any time and for any reason at our discretion (even if it’s premature to a specific time or date implied, given and/or displayed).

We cannot always guarantee that an item posted on our Site (as “in stock” or otherwise) will still be in stock and/or available at the time you place your order. When an item sells, we attempt to delete, change and/or modify the listing as soon as possible, however, there may at times be delays and you may attempt to place an order for an item that has already been sold even though the listing is still being displayed. We do not warranty, represent or guarantee that you will be able to purchase the item just because the item is being displayed and offered for sale on our Site. Even if you are successful in placing your order, we cannot guarantee that the item will be available. We reserve the right to cancel, refuse, reject and/or refund any orders placed with us for any reason we deem necessary.

Prices on any items, jewelry and rings we may offer are subject to change at anytime without notice regardless of advertised pricing or the method in which they are being displayed and/or advertised. Items listed and/or advertised in any manner by Shay’s Diamonds & Jewelry are subject to prior sale and therefore may no longer be inventoried and available at the time you may inquire or wish to purchase the item(s) even though they may still be advertised and/or displayed.

14. Suggested Retail Values:

When we display our items on our Site, we will oftentimes present some form of full value or comparable item value for the item. We may use many different terms to express the various types of full maximum values (“Value Indicators”) for these items. Some of the Value Indicators we may use (but are not limited to) are listed below:

The Value Indicator prices we display represent either the manufacturer suggested retail price and/or an actual retail price of a comparable and similar item sold by online jewelry merchants and/or department stores and/or local jewelry stores.

Value Indicator prices can also be established by using a standard retail price formula that the jewelry industry has created for calculating the maximum full retail value of gold, diamonds and jewelry. The Value Indicator retail pricing formula we may use has been qualified and accepted as a standard pricing model in the diamond and jewelry industry for many years. Weekly wholesale diamond market prices and spot gold prices do fluctuate and are averaged and factored into the overall general retail pricing formula at the time we establish the pricing for a particular item.

Value Indicator prices are displayed to potentially show what the maximum full retail price could be using the established ‘comparison’ and/or retail pricing mechanisms indicated above. Although we feel our Value Indicator prices may represent the maximum full retail value for the items being offered, we make no claims, warranties or guarantees that the “Suggested Retail” price or any of our Value Indicator prices are the certified appraised value of the item or the replacement value of the item. We do not represent that the appraised value or Value Indicator price we may display would be the amount other vendors and/or retailers would sell at or the amount you would pay at other merchants. It is possible that you may be able to purchase a similar item elsewhere for less than the Value Indicator price we posted on that specific item. Likewise, should you decide to sell an item you purchased from our Site, we do not imply, represent or guarantee that the Value Indicator price will be the amount (or near the amount) that you will be able to sell the item at. Furthermore, should you receive an appraisal from us with your item, and/or should you decide to get your own independent appraisal on the item, we do not suggest, represent or guarantee that the appraisal value(s) will be the same (or near) the Value Indicator price we displayed for the item. The Value Indicator prices we display have simply been established using the standard pricing methods and criteria indicated above which are standard and acceptable practices within the diamond and jewelry industry for generating the maximum full value retail price of an item.

It is understood that spot gold prices and wholesale diamond prices do fluctuate so the appraisal value and/or “Suggested Retail” price and/or Value Indicator prices displayed may vary and be either higher or lower at the time you purchase your item.

15. Wholesale Prices:

When you browse the items on our Site, you will notice that we typically have a “Suggested Retail” price or a Value Indicator price displayed on each item. You will notice that we also typically display another lower price on each item which is the price you can purchase the item at. The lower price that you can purchase the item at is typically what we refer to as our “wholesale” price. We may also use various other terms and/or titles to describe the wholesale price we offer such as (but not limited to): “Shay’s Price”; “Wholesale Price”; “Discount Price”, “Your Price” and others.

When you purchase a diamond ring or any item from us or our Site, you do not pay the “Suggested Retail” price or the Value Indicator price – instead, you will be purchasing your item at the lower wholesale price that’s also displayed on the item.

From time to time, we may also put our items on sale or on clearance in which we may use the following terms (but not limited to): “Sale Price”; “Clearance Price”; “Closeout Price”; “Liquidation Price”; “Special Price”; “Discount Price”. Buyers on our Site and local purchases made in person are able to purchase items at the price we list the item at. We reserve the right to change our prices (posted, printed or otherwise) at anytime and/or retract any items we may have listed for sale at any time and for any reason at our complete determination and discretion.

The wholesale price that we offer on our items is termed as ‘wholesale’ because we attach a very minimal percentage markup over the actual cost we incur to obtain and/or manufacture the item. The percentage markup we attach to our items is in line with the typical markup margins associated with the wholesale jewelry industry, thus we term the prices of our items as “Wholesale” prices.

If you choose to trade or resell an item (or items) that you purchased from our Site, we do not represent, guarantee or imply that you will be successful in making the sell or trade, or generating a profit from the sell or trade just because you purchased your item from us or our Site and/or at the wholesale price we offer. Although we believe our prices to be at a wholesale level, the economy, demographics, marketing ability and various market conditions make it impossible for us to imply, represent, predict or guarantee that you would be able to resell or trade our items at all and/or that any sale or trade of our items that you may generate would result in any actual profit. We do not imply, nor do we guarantee that you will be able to successfully resell or trade our items at, near or above the wholesale price you purchased the item at. Likewise, we do not imply, represent or guarantee that you will be able to successfully sell or trade our items at, near or above the Value Indicator price displayed on any item.

Although we primarily offer our items at wholesale prices, we also reserve the right to also offer our items at their regular prices, appraised values and/or discounted prices and/or sale prices at any time.

16. Appraised Values:

The appraisal value generally denotes the estimated maximum retail value of the item and/or the estimated maximum replacement value of the item.

Our policy is to never perform our own ‘in-house’ grading certificates and appraisals on items we sell. We believe this is a conflict of interest and our customers would not feel comfortable if we performed our own certification. That’s why we’re willing to incur the extra cost of always using independent and trusted 3rd party appraisal firms that are qualified, professional and consistent in how they grade diamonds and appraise jewelry.

If an Appraisal Certificate is included with your item, you may find that our “Suggested Retail” price and/or our Value Indicator price that was originally displayed on the item may or may not be the same as the value provided on the Appraisal Certificate. Likewise, you may find our “Suggested Retail” price and/or our Value Indicator price to be higher or lower than the value provided on the appraisal certificate (or on any independent appraisal you may have conducted on your own after you purchased the item). We do not represent, imply or guarantee that our “Suggested Retail” prices and/or our Value Indicator prices will be the same as any appraisal you may have performed independently or that they may be the same as the value provided on the appraisal certificate that may be included with your item.

All certifications and appraisals provided by us have been performed by qualified and reputable 3rd party companies that are knowledgeable and experienced in appraising fine diamond jewelry. Please note that the art of grading diamonds and providing jewelry appraisals can vary as it is a subjective process based upon each individual examiner’s personal training, experience, ability and professional evaluation. Therefore, appraisals and grading performed on the same item by two different companies or appraisers will generally differ in their values, descriptions and gradings to various degrees. Although Shay’s Diamonds cannot guarantee the accuracy of any data or information provided by third-party companies, we always attempt to use reputable and established grading labs, gemologists and professional jewelers who have a proven track record of consistency, reliability and accuracy in their grading performance and appraisals. Although we do our best to utilize knowledgeable and experienced companies to perform our certification and appraisals, we take no responsibility or liability for their actions, work, information, grading or values, nor do we imply, represent or guarantee the accuracy or evaluation of their description, information, certification, grading and/or appraisal value or replacement value.

If you decide to get a secondary independent appraisal or certification performed at your own expense, we do not represent or guarantee that the information or value will match or be similar to the information or value on the appraisal or certification that we provided with your item that was performed by a 3rd party company.

If you plan on insuring your diamond ring, most insurance companies will include jewelry coverage up to a specific amount under an existing homeowner’s insurance policy. If you need to get a separate ‘floater’ policy, then most insurance companies will require an appraisal on the specific item. Each insurance company has different policies and requirements regarding the type of jewelry appraisals and information they need. We do not represent, nor can we guarantee that every insurance company will accept the “Appraisal Certificate” we supply as each insurance company operates under its own unique set of rules. In some cases, if you plan on insuring your item, you may need to get an additional independent appraisal performed at your cost even though we provided an “Appraisal Certificate” with your item. 17. Certification:

Shay’s Diamonds offers both certified and uncertified diamonds. Many of the rings we offer have already been certified and will come with either a “Certificate of Authenticity” or an “Appraisal Certificate” unless specifically stated otherwise. Any uncertified diamond ring that we offer can be graded, certified or appraised at your request for a nominal fee. For the benefit and comfort of our customers, our policy at Shay’s Diamonds is to never perform the grading and certification on the rings we sell as we feel it would be a conflict of interest. We always use a reputable and independent third-party grading company to perform the certifications on our rings.

A “Certificate of Authenticity” will validate that the diamonds on the ring are real diamonds and it will also give you all the grading details about each diamond on the ring (such as size, clarity, color, cut, etc.). An “Appraisal Certificate” will offer the same information as a “Certificate of Authenticity”, but it will also provide an “estimated retail value” or “estimated replacement value” for the ring. When viewing diamond rings on our Site, the description page for each ring will let you know whether a ring has been certified and if so, which type of certification it has.

If you decide to get your own diamond grading or appraisal performed and you hire a competent jewelry appraisal firm to conduct your own diamond grading and/or appraisal for your ring at your expense, you may find the grading and/or value to be different and/or higher or lower than the grading and/or value provided on the certification or appraisal you received from us. Likewise, you may find that our “Suggested Retail” price or other Value Indicators that we display on our items may be higher or lower than the value on the “Appraisal Certificate” we provide and/or on any appraisal you may have independently performed. Since certification and appraisals can be subjective and since we do not perform and provide our own grading certificates and appraisal documents, we will not be liable or responsible for any variances or discrepancies between diamond grading values and/or appraisal values that might occur between different appraisals and/or with our “Suggested Retail” price or Value Indicators.

18. Item Availability:

If you are not a local customer and need your ring shipped, we will usually ship rings that are in stock within 3 business days. Custom orders, non-stock items and specialty requests may take up to 12 business days or more before shipment. We will keep you notified via email as to the progress of your order and shipment. We cannot always guarantee that an item posted on our Site (and/or posted as “in stock”) or advertised through any other manner, will still be available at the time you inquire and/or place your order. We cannot guarantee that the items posted for sale on our Site or advertised by us will always be in production and still available. If you purchase an item from us that is no longer available and we are unable to provide it to you, we will contact you so that you can either make another selection or be issued a refund.

Prices are subject to change at anytime without notice regardless of advertised pricing. Items listed and/or advertised in any manner by Shay’s Diamonds & Jewelry are subject to prior sale and therefore may no longer be inventoried and available even though they still may be listed, advertised and/or published.


19. Ring Sizing:

We offer professional ring sizing at a discounted price at the time you place your order. If we make an error and your ring is not the size you ordered and written on your receipt, please contact us within 10 days of receipt of your item and we will resize the ring free of charge to the size you originally ordered and indicated on your receipt. Please note that we cannot guarantee that the ring will fit properly, we can only guarantee that the ring will be the size you requested. It is important that you determine the exact ring size you need prior to having us size your ring. Additional ring sizing will be charged service and labor fees.

20. Our Diamonds:

All our diamonds are 100% genuine and authentic natural diamonds. We do not sell any type of imitation diamond such as Moissanite, simulated, CZ, synthetic, lab created or manmade (unless specifically stated on the item’s description). We do not sell ‘blood diamonds’ or any type of conflict diamond based upon our diamond suppliers’ commitments and the information they provide to us.

Shay’s Diamonds can provide you loose diamonds as well as finished rings. Our diamond rings are extremely elegant and stunning and are hand-crafted right here in the USA by our team of expert jewelers.

We offer a wide variety of quality diamonds to meet anyone’s budget or preference including GIA; EGL; clarity enhanced; colored diamonds; certified; uncertified and more. We can also provide any type of cut, clarity, color or size that you desire.


21. Custom Ring and Jewelry Design:

We also offer custom ring design and manufacturing to our customers. Our Site shows only a small sample of the many diamond ring designs we have available. We literally have thousands of designs and styles to choose from. We can also custom manufacture almost any design you provide. Custom orders may take up to 12 business days or longer for completion. Custom orders cannot be cancelled once they have been placed with us. All custom orders are non-refundable and non-returnable and will not be covered under our guarantee policy.

22. Shipping:

If you are not a local customer, then we can ship your item to you. We provide shipping to any location in the U.S.A. We can also ship to Canada and Internationally. We will ship your ring or jewelry by either FedEx® 2-day or USPS Priority Mail®. We will determine at our discretion which delivery service we will utilize based upon your location and the price of the item you purchased. The shipping fee will be charged in addition to the price of your item. We will contact you by email when your item has shipped and we will provide you a tracking number so that you can track your package. A signature will always be required upon delivery of your package. Local customers in the Sacramento, California area can pick up their order rather than having it shipped. We reserve the right to change shipping methods or carriers at our discretion and for any reason we deem necessary.

23. Taxes:

We do not charge sales tax on any orders shipped outside of California. All local purchases and orders shipped to a California address will be charged sales tax. If you are a reseller who lives in California and you have a current Resale Permit number, you can provide us your permit number and fill out the reseller’s form in order to eliminate the sales tax on your orders provided you are purchasing the items to resell and they are not intended for personal use.

24. Product Images and Descriptions:

We attempt to accurately depict the items offered on the Site both visually (through our images and pictures) and also through our descriptions. However, because pictures and images are dependent on your computer screen resolution and monitor, (among other factors), we cannot guarantee full visual accuracy for each picture or image we depict on our Site. Various types of lighting and lighting angles may also create a variance in the visual effect of the item depicted.

Enlarged Photos: Pictures of jewelry offered on our Site may be magnified up to 30 times its normal size or larger in order to provide you a viewing advantage in examining all the details of the item. Please refer to the item’s full description on the item’s description page to determine and evaluate the actual details and characteristics of each particular item (such as, but not limited to: size, weight, length, condition, carat, color, cut, clarity, etc.). Gram Weight: The gram weight on our rings may vary slightly from what is described based upon slight manufacturing variances; the type of metal you choose for your setting; and the ring size and diamond you select.

Carat Weight: Although we make every effort to describe carat weight as accurately as possible, the individual carat weight of each diamond and the total carat weight of the entire ring or item may vary slightly from what we describe due to some diamond measurements being made while the diamonds are set in the mounting as opposed to being weighed directly on a carat scale prior to mounting.

Color & Clarity Description:
If your item comes with certification (such as a “Certificate of Authenticity” and/or “Appraisal Certificate” and/or “Grading Card”), all information and data indicated on those certificates are provided by an independent third-party company other than Shay’s Diamonds. Although we always attempt to use reputable and established grading labs, gemologists and professional jewelers who have a proven track record of consistency, reliability and accuracy in their grading performance and appraisals, we in no way will be liable and/or will take responsibility and/or guarantee and/or endorse the accuracy of any data, information, grading or values provided by third-party companies who provide certification, appraisals and grading on our diamonds, gems and jewelry. Should any conflict arise based on the information they provide, you would need to contact the grading company who issued the certification and deal with them directly.

If your item does not come with any form of certification, then we will attempt to describe the diamond (or gem, stones, ring and/or item) to the best of our ability which may include an approximate clarity grade or range and an approximate color grade or range along with a description of the diamond shape and approximate carat size. However, although we are knowledgeable about diamonds and fine jewelry, we are not certified gemologists nor do we make any claim that we are or have such training. Therefore, we assume no liability for the descriptions, grading and information we provide when an item is not accompanied by a third-party grading certification and/or appraisal. In no way do we represent, guarantee and/or warranty that our descriptions (such as but not limited to; carat size; color; clarity and cut) which we display, advertise and/or broadcast for each item we offer will be the same and/or near the evaluations and/or grading conducted by other jewelers, appraisers and/or gemologists as grading is subjective in nature. However, we always attempt to do our best and be as fair, accurate and honest as possible when offering descriptions of diamonds and jewelry items that do not have third-party certification.

Gift Box: Each ring or jewelry item comes with a special gift box or bag. The gift box or bag we provide may or may not necessarily be the same as any image or picture of a gift box that we may display on our Site or through any other advertising methods we may utilize. The choice of style, type and quality of gift box or bag we provide with each item is totally made at our discretion.

25. Canceling an Order:

If you place an order with us and then decide to cancel your order prior to it being shipped, you may do so in writing by either fax, email and/or regular mail. Any cancelled orders will be charged a cancellation fee in order to help cover our labor and processing costs which we initially incurred to start your order. The cancellation fee will be the greater of either: A) 5% of the purchase price or; B) $75. We reserve the right to change and/or modify our fees at any time. Once an order has been shipped, it cannot be cancelled. Local customers cannot cancel an order once it has been paid for or once a down payment has been mande. Custom orders cannot be cancelled once they have been placed with us.

26. Refusing Delivery of an Order:

Once your order has been shipped, we do not allow you to refuse delivery of your item. If you do refuse delivery of your item and the package is returned back to us, you will be charged a shipping & handling fee along with a return delivery fee of the greater of either: A) 5% of the purchase price or; B) $75. A refund will not be given and your item will be subject to the terms of our guarantee policy. We reserved the right to change and/or modify our fees at any time.

27. Diamond Treatments:

If you purchase a color treated diamond and/or a clarity enhanced diamond from us, if for any reason should the diamond ever need to be retreated, we can offer retreatment services at a cost of $120 per carat. Treatment time can vary and take anywhere from one week up to 3 weeks for completion of the treatment process. The customer will pay the shipping fees to ship the diamond to us and we will pay the shipping fees to return the treated diamond back to the customer.

28. Guarantee and Returns:

Shay’s Diamonds offers you a complete guarantee and return policy on our beautiful diamond jewelry. We perform a full quality inspection on your item prior to shipment to make sure that your item gets to you in perfect condition with absolutely no damage. If you are not completely delighted with your purchase, simply contact us within 7 days of delivery of your item and you can return your item to us for a full store credit (custom orders, sale items, closeout, liquidation and clearance items are excluded from our guarantee policy and cannot be returned for any reason). Returned items that are accepted under our guarantee policy will be issued store credit - we do not issue refunds of any kind. Under the conditions and stipulations of our guarantee policy as set forth on our Site, you will have a 7 day inspection period from the time you receive your item to determine whether you wish to keep your item or return it. You can contact us anytime within the 7 day time period to return the item provided that the item has not been worn and shows no signs of wear or usage and provided that the item has not been damaged in any way. The term “damaged” includes but is not limited to: scratches; dents; dings; breaks; engraving; missing diamonds or stones; broken diamonds or stones; chipped or cracked diamonds or stones; exchanged diamond or stones; welds; broken or missing prongs or heads; sizing not performed by us and any like issues. Jewelry items may not be returned after the 7 day inspection period regardless of the reason; whether defective; a diamond, stone or gem falling out; missing or damaged diamonds, stones or gems; any type of damage; customer dissatisfaction or otherwise.

Before returning an item, you will need to contact us to obtain a “Return Authorization” # (RA#). If you are not local, we will also give you a special address to return your item to. Please do not send your return to our corporate mailing address. Items returned to our corporate mailing address will be refused.

Items that are returned must be accompanied by their original receipt. Upon receipt of the returned item, you will receive store credit of your purchase price for the item returned (we do not issue refunds of any kind). Store credit does not include the shipping, handling and insurance costs we originally incurred to send you the item. Store credit can be used to purchase any items we have in stock which are listed on our website (excluding sale items, closeouts, liquidation and clearance items) – store credit cannot be used to purchase non-stock items and custom designs. Returned items must be accompanied with the original receipt and store credit must be used within 30 days from the date you returned the item.

When an item is returned and a different item (or items) is purchased using store credit, the new item (or items) purchased with the store credit cannot be returned again for any reason – our guarantee applies only to original purchases and does not apply to items that have been purchased using store credit.

Diamonds are considered to be the hardest natural substance on the earth, but they can still be damaged or chipped if they are hit with an impact. Prongs, mountings and settings can easily be bent or altered if hit or simply snagged on a piece of clothing or other fabric. This can cause stones to become loose and even fall out. Fine diamond jewelry is extremely valuable and should be treated accordingly by the user. Therefore, Shay’s Diamonds will not be responsible for any damage that may occur to an item after the sale is made. We do not perform free repair service or issue refunds, replacement or store credit for any damaged items regardless of how the damage occurred. All custom orders cannot be returned.

Settings, mountings and prongs can become unsettled and cause stones to become loose and even fall out. It is important that you take your jewelry in regularly to a competent jeweler in your area for cleaning and inspection. Once you purchase a piece of jewelry from us and it is in your possession, you assume full and total liability for the item. We will not be responsible or liable for any damage (including but not limited to loose and/or missing diamonds or gems) that may occur once the jewelry is in your possession. Although our jewelry is made with very high quality standards, we cannot guarantee that the diamonds and/or gems won’t become loose at some point with the potential of possibly falling out. Beautiful diamond jewelry is a precious item and should be given the utmost care and attention. That’s why it’s important to have all your fine jewelry inspected and cleaned by a professional jeweler on a regular basis.

29. Assignment of Rights:

All items sold on our Site come with our guarantee and return policy. The guarantee policy that we provide is non-transferable and is only available to the initial buyer who originally purchased the item from us.

30. Testimonials:

We may offer various customer comments and/or testimonials from our clients on our Site. All customer comments and testimonials provided on our Site are real submissions and not manufactured by us. We will keep the original full information provided to us by the client on file at our offices.

You acknowledge that if you provide us any comments and/or testimonials (verbal, written or otherwise), we may use them in whole or part to publish on our Site (or through other means) without the need of getting any form of consent or approval from you (written or otherwise). In such cases, we will not provide your full address when we publish the comment or testimonial. We reserve the right to edit the full text of client comments and testimonials and show only portions thereof that we may select.

Our client comments and testimonials may or may not be unsolicited. In some cases, we may solicit a testimonial from a satisfied client and/or we may offer a premium, fee and/or contest prize to those who may provide us comments and/or testimonials.

We will not use full names and/or addresses and/or full contact information and/or pictures/images on any client who provides comments and/or testimonials unless otherwise given full approval and permission to us in writing by the client who has provided such information.

31. Search Engines and Search Results:

Our Site may also provide a search engine (or several search engines) that may be used by anyone on our Site. These search engines may be an internal part of our Site, or may be offered and performed by third-party companies operating apart from our Site. We will attempt to provide accurate and relevant search results based upon the keywords you input. We will not be liable or responsible for any content ads and/or links that may be presented that you may find objectionable or offensive.

We may employ and allow you to use our own custom internal search engine and/or a search engine powered by another company while on our Site. The search results, ads and sponsored links we provide on our Site may be generated from a third party (or multiple third parties) and/or may be generated by our own servers, search programs, internal advertising programs and/or a combination thereof. In either case, we may post sponsored and/or advertiser links to your search results page based upon the keywords in your search, your Personal Information, and/or your buying and/or viewing preferences.

By using our search engines, you agree that we take no responsibility for the products, services, data or advertisements offered on our Site from these sponsored links and/or advertisements and/or third-party vendors. 32. Prohibited Conduct:

We reserve the right in our sole discretion to suspend or terminate your registration and/or membership and/or block your ISP address from connecting to and using our Site at any time for any reason we deem necessary or appropriate. 33. Releases, Limitation of Liability and Indemnification:

The releases, liability limitations and indemnity rights set forth below inure to the benefit of us, our parent or subsidiary entities (if any), our successors and assigns (if any), and our shareholders, investors, directors, officers, employees and agents.

Since we do not necessary control, endorse and/or inspect each ad, sponsored link and/or search result link based on your keywords, (and their respective websites and/or offers), that are displayed and presented on our Site, you understand and agree that we are not liable for, and you will not seek to hold us liable for, any representations or conduct of anyone who advertises on our Site or any search result links generated from your keywords. We do not and cannot promise that you will not find objectionable material or content on our Site or on links through our Site.

We likewise do not and cannot promise that our Site will operate in a continuous, flawless or secure manner. Outages, malfunctions and system failures caused by any number of foreseeable or unforeseeable factors may occur on our Site. You release and discharge us from liability for any and all claims, causes of action and damages that you might have against us, now or at any time in the future, arising directly or indirectly from your or any person’s use of the Site, products or ads, sponsored links or search results displayed. We will not be responsible for any loss of items purchased from us for any reason (such as but not limited to; theft; loss; shipping; lost stones, gems or diamonds) nor for any emotional and/or mental issues or trauma that may arise for any reason.

Notwithstanding the releases and liability limitations in this Agreement, in the event that we are found liable, you agree that our liability to you or a third party shall be no more than the sum of $250.

You further agree to indemnify and hold us harmless from any lawsuit, claim, cause of action or demand by any third party that relates directly or indirectly to your activity or purchase(s) from us and/or on our Site, including without limitation your breach of this Agreement, your reselling of items acquired from us or our Site, your violation of any applicable law, or your violation of any person’s legal rights. Your indemnity obligation includes without limitation the payment of our reasonable attorneys’ fees and legal expenses.

34. Reservation of Our Rights:

We reserve all rights in our Site. You may not copy, reproduce or display any portion of our Site, nor may you use any of our trademarks, without our prior express written permission.

35. Applicable Law and Dispute Resolution:

Please let us know as soon as possible if you have any concern relating to our Site and/or products so that we can attempt to resolve your concern.

You agree that this Agreement shall be governed by the laws of the State of California without regard to conflict of law principles. This means that California law will govern the interpretation and enforcement of this Agreement regardless of where you live or work, and regardless of where any transaction is performed or to be performed.

If a dispute arises between you and us, and it is not resolved by mutual agreement, you agree that the dispute will be adjudicated in the Superior Court of California in and for the County of Sacramento, and you consent to the jurisdiction of that court. The prevailing party shall be entitled to any reasonable court costs and attorney fees.

You agree to bring any claims that you may have against us within six months of the date they accrue, regardless of any longer statute of limitations that otherwise might apply.

36. General:

Any trademarks, service marks, brand names or product names that you may find on our Site are the property of their respective owners and do not necessarily indicate affiliation with or endorsement with us by their respective owners.

We may not take prompt action, or any action, to remedy each breach of this Agreement, but our forbearance shall not be deemed a waiver of our right to enforce any provision of this Agreement.

We make every attempt to ensure that our Site is as accurate, correct and as complete as possible. However, mistakes and errors do occur. We reserve the right to correct any mistakes and/or typographical errors on prices, descriptions and/or anything else that we display and/or describe on our Site. If you find an error of any kind on our Site, please contact us so that we may investigate and correct it. In the event an item is listed with an inaccurate description and/or incorrect price due to data-entry mistakes or other errors, we retain the right to correct any such mistakes or errors and refuse, cancel and/or refund any orders placed for the item listed with the incorrect information.

We reserved the right to refuse service to anyone for any reason that we deem appropriate and necessary. We reserve the right to retract any order that has been placed with us at our discretion. If the order is already placed and we determine to reject the order, we will issue a refund for the amount paid and the order will not be processed.

If any part of this Agreement is found to be invalid or otherwise unenforceable, the remaining portions shall be enforced.

This Agreement, including any writings on our Site and any writings that are referenced in this Agreement, sets forth the entire understanding of the parties with respect to the subject matter hereof, and any modifications must be in writing and expressly approved by us.
